Data Processing Agreement (DPA)

This Data Processing Agreement forms part of the Terms and Conditions of Business between AJH Financial Accountant Limited ("AJH Accountants", "we", "us", "the Processor") and the client engaging our services ("the Client", "you", "the Controller").

1. Definitions

Data Controller

The entity that determines the purposes and means of the processing of Personal Data (The Client).

Data Processor

The entity which processes Personal Data on behalf of the Controller (AJH Accountants).

2. Scope and Nature of Processing

We will process Personal Data strictly to provide the accounting, payroll, bookkeeping, and tax services outlined in your engagement.

  • Categories: Your employees, directors, shareholders, customers, and suppliers.
  • Types: Names, addresses, DOB, NI numbers, salary details, tax codes, and bank account details.
  • Duration: For the duration of our commercial relationship.

3. Our Obligations as the Processor

3.1 Process strictly on instructions: We process Personal Data based on your documented instructions unless required by UK law.

3.2 Confidentiality: All personnel authorized to process data are committed to strict confidentiality.

3.3 Security: We implement technical and organizational measures to protect data against accidental loss or unauthorized disclosure.

3.4 Sub-processors: You authorize our use of third-party tools (e.g., Xero, QuickBooks) provided they are bound by the same data protection obligations.

4. Your Obligations as the Controller

  • verifiedYou have a lawful basis for processing the data you share with us.
  • verifiedYou have provided necessary privacy notices to data subjects.
  • verifiedThe data provided is accurate, up-to-date, and limited to what is necessary.

5. Deletion or Return of Data

Upon termination, we will either delete or return all Personal Data processed on your behalf, unless UK law (such as HMRC record-keeping requirements) requires us to retain a copy for a statutory period.

7. Governing Law

This DPA is governed by the laws of England and Wales.
